How Cobb County Handles Uncontested Divorce Cases
How Cobb County Handles Uncontested Divorce Cases
If you and your spouse can cooperate, a Cobb County uncontested divorce may be the easiest, most affordable way to move forward. We handle these divorces for a flat fee, and our clients never need to visit our office or appear in court—unless a judge specifically requires it.
As of now, our flat fee for an uncontested divorce in Cobb County starts at $695 (no minor involved) or $1,225 ( minor involved). That includes attorney-prepared documents, personalized legal advice, and guidance from start to finish. The only additional cost is the court’s filing fee—usually $275—which is paid later, when your case is ready to file.
A Law Firm That Knows Cobb County
We’ve been handling divorce cases in Cobb County for more than 20 years. Early in our practice, we handled many contested divorces—expensive, stressful, and often slow. But over time, we saw how many people needed legal help for something simpler: a fair, cooperative split.
So, we shifted our focus. We restructured our pricing into flat fees and streamlined our systems. That allowed us to serve more clients—without compromising legal quality. We still deliver high-level legal work, but in a format that’s accessible and affordable.
Since then, we’ve completed thousands of Cobb County uncontested divorce cases. We know the judges, the courthouse, and the practical realities of getting a case finished—quickly and properly.
Cobb County Divorce Courts: What’s Changed
Cobb County now has 11 Superior Court judges who can handle divorce cases. Over the years, many longtime judges have retired or taken “Senior Status” (meaning they still hear cases occasionally). That gives Cobb County a reliable and flexible group of judges who keep cases moving forward.
The Superior Court is now housed in a modern courthouse near Marietta Square, bringing all courtrooms under one roof. It’s a major improvement from the old days, when courtrooms were scattered across the county.
No Office Visits. No Court Appearance (Usually).
Today, we handle 100% of Cobb County uncontested divorce cases remotely. You don’t need to visit our office, take time off work, or sit in traffic. Everything is handled by phone, email, and secure document delivery.
We made this shift several years ago and never looked back. It works better—for you and for us. Whether your case is simple or involves issues like children, joint debt, or property, we start with a scheduled phone consultation and guide you through the entire process.
How the Process Works
Step 1: Submit the Client Inquiry Form
This online form gives us the basics about you, your spouse, and your situation. It helps us determine whether your case is a good fit for an uncontested divorce.
Step 2: Optional Free Phone Consult
Before completing the form, you’re welcome to schedule a free 15–20 minute call with us. We’ll answer preliminary questions and help you decide whether this process is right for your situation.
Step 3: Schedule Your Attorney Conference
Once you’re ready, you can use our online scheduler—or just call us—to set up a full phone appointment. That conference may be short (for simple cases) or more detailed if your situation involves children, debt, retirement accounts, or real estate.
Step 4: Pay Flat Fee & Begin Document Prep
During your phone appointment, you’ll pay our flat fee and we’ll begin preparing your divorce documents. We’ll walk through all the necessary details:
-
Alimony
-
Custody and visitation
-
Child support
-
Health insurance
-
Property division (real estate, bank accounts, vehicles, etc.)
-
Retirement accounts
-
Debt allocation
Document Review, Signing, and Filing
After your call, we draft the full Settlement Agreement, along with a Child Support Worksheet and Parenting Plan if you have minor children. These are sent to you by email for review. Once both you and your spouse confirm the documents are accurate, we send the final version for signature.
Each spouse must sign in front of a notary. Once signed, the physical documents are returned to us—no faxes or scans. At this point, you’ll also pay the $275 court cost, and we’ll file everything with the Cobb County Superior Court.
Final Steps and Waiting Period
Once filed, there’s a mandatory 31-day waiting period. A judge is assigned to your case at random. At the end of the 31 days, we formally ask the judge to approve your uncontested divorce.
Cobb County’s Required Co-Parenting Seminar
If your uncontested divorce involves minor children, both parents are required to complete Cobb County’s Co-Parenting Seminar. This four-hour seminar is taken online and must be completed before the court will finalize your divorce.
You and your spouse do not have to attend the seminar together, but each of you must complete it individually. We’ll provide the link and instructions when the time comes and make sure the court receives confirmation.
Some judges require a short court hearing—especially if minor children are involved. In those cases, we usually appear with you at no extra cost (though some exceptions may apply).
However, most Cobb County judges allow uncontested divorces to be granted by written motion, with no hearing. If that’s the case, we’ll prepare an affidavit for you to sign in front of a notary and return to us. We submit that affidavit and your Final Decree to the court, and once the judge signs, you’re divorced—without ever setting foot in the courthouse.
